A. Introduction and acceptance of terms

These Terms of Service govern access to and use of the kezate.info website, operated by Kezate, registered office Botanická 16, Brno, Czech Republic. By browsing this website or submitting the contact form, you confirm that you have read and accepted these terms. If you do not agree with any part of them, please refrain from using the website.

B. Description of services provided

Kezate provides energy efficiency audits and monitoring setup for small commercial buildings, consisting of installation of circuit-level smart meters, thermal imaging surveys of the building envelope, and monthly consumption reports with prioritised, ROI-costed recommendations. Services described on this website are informational in nature; any specific engagement is governed by a separate written agreement between Kezate and the client.

C. Nature of engagement: measurement and reporting only

Kezate operates exclusively as a measurement and reporting service. Kezate does not sell, supply, or install energy-related equipment for permanent use, and does not perform construction, renovation, or building works of any kind. Recommendations contained in any report are informational and do not constitute an offer, guarantee, or professional engineering certification of specific outcomes.

D. Client obligations and site access

Where a monitoring agreement is in place, the client is responsible for providing reasonable access to the building's electrical distribution board and relevant areas of the building envelope, and for ensuring that any necessary internal authorisations for such access have been obtained prior to a scheduled visit.

E. Limitation of liability

Reports and recommendations are prepared on the basis of measured data available at the time of the survey and reflect conditions observed during that period. Kezate does not guarantee any specific level of energy saving resulting from following a recommendation, since actual outcomes depend on decisions and actions taken independently by the building owner or their chosen contractors.

F. Intellectual property in reports

Reports, thermal images, and consumption data compiled for a specific client under a monitoring agreement become the property of that client upon delivery. The general website content, including text and design elements of kezate.info, remains the property of Kezate and may not be reproduced without prior written permission.

G. Termination of monitoring agreements

Either party may terminate an ongoing monitoring agreement in accordance with the notice period specified in that agreement. Upon termination, installed metering hardware belonging to Kezate is scheduled for removal, and any data collected up to the termination date remains accessible to the client as described in the applicable agreement.

H. Governing law and jurisdiction

These Terms of Service are governed by the laws of the Czech Republic. Any dispute arising in connection with the use of this website or an associated monitoring agreement falls under the jurisdiction of the competent courts of the Czech Republic, without prejudice to any mandatory consumer protection provisions applicable in your place of residence.
